Clinical Guideline Protection Legislation Introduced

On February 27, 2014, Representatives Andy Barr (R-KY-6) and Ami Bera, MD (D-CA-7) introduced legislation for the development and dissemination of clinical practice guidelines that could provide limited 'safe harbor' protections for physicians.

H.R. 4106 would also establish the right of removal to federal court, any malpractice actions involving a federal payer like Medicare.

Members of the Health Coalition on Liability and Access, of which ASPS is a member, have been working closely with Representatives Barr and Bera on drafting the language.
